Terms & Conditions — Settha

Last updated: October 26, 2026

These terms govern the use of Settha's two applications: the travelers app and the agencies and creators app.

1

Scope

SETTHA TECHNOLOGIES S.A.S. operates two Android applications on the same platform: • Settha (com.dodderware.settha), for travelers who discover and book tours. • Settha Agencies (com.dodderware.settha.agency), for the agencies and creators who publish those tours and manage their bookings. These Terms apply to both. Marked sections indicate when an obligation applies only to travelers or only to agencies. We also publish a per-application version with the same content: • Travelers: https://settha.com/terms/travelers • Agencies and creators: https://settha.com/terms/creators By creating an account or using either application, you accept these Terms.

2

Definitions

• Settha: SETTHA TECHNOLOGIES S.A.S. (NIT 901984471-6), based in Medellín, Antioquia, Colombia. • Platform: Settha's mobile applications, the settha.com website and the associated services. • User or Traveler: the person who uses the travelers application to discover and book tours. • Agency or Creator: the individual or company that publishes tours and provides the tourism services. • Tour: the tourism experience published by an Agency. • Booking: the agreement between a Traveler and an Agency for a Tour on a given date and time.

3

Nature of the service

Settha is a marketplace that connects Travelers and Agencies. Settha does NOT provide the tourism services itself. The contract for the tourism service is between the Traveler and the Agency. Settha acts as an intermediary: it provides the platform, processes payments and enables communication between the parties. The Agency is solely responsible for delivering the Tour, for its safety, for holding the permits and insurance required by law, and for the accuracy of the information it publishes.

4

Eligibility

To create an account in either application you must be at least 18 years old and have legal capacity to enter into contracts. Settha is not directed at minors and does not create accounts for them. An adult may book for a minor travelling with them, indicating this at the time of booking. In addition, to register as an Agency you must be properly registered with the Colombian National Tourism Registry (RNT) where the law requires it for the activity offered, and hold the applicable permits and insurance.

5

User account

You are responsible for the accuracy of the details you register and for keeping your credentials confidential. You must tell us without delay if you detect unauthorised use of your account. You may close your account at any time from the app (Settings → Manage account → Delete account), from https://settha.com/account/delete, or by writing to [email protected]. Obligations outstanding at closure (confirmed bookings, payouts, tax obligations) survive until fulfilled.

6

Bookings (travelers)

By booking, the Traveler accepts the date, time, meeting point, price and cancellation policy published by the Agency for that Tour. The Booking is confirmed when payment is approved. Settha notifies both parties and enables the chat between them. The Traveler must arrive at the meeting point at the stated time. Failure to attend without prior cancellation is governed by the Tour's cancellation policy.

7

Payments (travelers)

Payments are processed through Wompi (Bancolombia S.A.). Settha does not store card details or CVV. Published prices include applicable taxes unless stated otherwise. The final Booking price, including any add-on services the Traveler selects, is calculated and confirmed on the server before payment.

8

Commissions and payouts (agencies)

Travelers pay for bookings through Wompi. Settha receives the funds and pays them out to the Agency after deducting Settha's applicable commission, the taxes due on that commission, and the payment gateway costs. The agencies application shows an estimate of the net amount before a Tour is published. It is an estimate: the final amount depends on the transaction actually processed. The Agency is responsible for its own tax obligations and for keeping the registered payout bank account up to date.

9

Cancellations, right of withdrawal and refunds

Each Tour has a cancellation policy set by the Agency and shown before booking. Cancellations within the permitted window give a full or partial refund according to that policy. Right of withdrawal ("retracto", Law 1480 of 2011): under the Colombian Consumer Statute, the Traveler may exercise the right of withdrawal within five (5) business days of the Booking, provided the service has not yet been delivered. The refund is processed within the following 30 calendar days. The Agency authorises Settha to process that refund and to deduct the amount from the next payout. If the Agency cancels a Tour for reasons attributable to it (overbooking, no-show, internal causes), the Traveler is entitled to a full refund or to reschedule, and the cancellation costs may be deducted from the Agency's payout.

10

Content and licence

The Agency retains ownership of the content it publishes (videos, photos, descriptions). By publishing it, the Agency grants Settha a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it within the Platform and in promoting the Platform, for as long as the content is published. The Agency warrants that it holds the necessary rights to that content, including the consent of any people appearing in it. Reviews, messages and photos posted by a Traveler remain theirs, under the same limited licence to display them on the Platform. Reviews are public.

11

Community guidelines

Settha has zero tolerance for objectionable content and abusive users. We review reports within 24 hours at most, and when the rules are broken we remove the content and suspend or permanently close the account responsible. By publishing tours, reviews, messages, photos, videos or any other content on Settha, you accept the Community Guidelines, available at https://settha.com/guidelines. Those Guidelines define the content and conduct we do not allow, including: sexual content or child sexual abuse material, graphic violence, harassment, hate speech, impersonation, illegal activity and violations of other people's privacy. Both applications let you report content and users, and block another user. Reports are reviewed and may lead to content removal or account suspension.

12

Prohibited conduct

You may not: • Publish false or misleading information, or information that does not match the service actually provided. • Take a booking that originated on Settha off the Platform in order to avoid the commission. • Impersonate another person, agency or Settha. • Interfere with the operation of the Platform, attempt to access other people's accounts, or extract data by automated means. • Use the Platform for illegal activity or to offer services for which you lack the required permits. • Publish content that breaches the Community Guidelines.

13

Moderation, suspension and termination

Settha may remove content, suspend or terminate an account where there is a breach of these Terms or of the Community Guidelines, where a competent authority requires it, or where it is necessary to protect the Platform's users. Whenever reasonably possible we will state the reason and give an opportunity to put things right. In serious cases, particularly those affecting people's safety, removal or suspension may be immediate. You may end your relationship with Settha at any time by closing your account. Confirmed bookings and outstanding financial obligations survive.

14

Settha's intellectual property

The Platform, its software, brand, design and databases belong to Settha or its licensors and are protected by applicable law. These Terms transfer no rights over them. You may not copy, modify, decompile or create derivative works of the Platform, except to the extent permitted by law.

15

Disclaimers and limitation of liability

The Platform is provided "as is". Settha does not warrant that it will be available uninterrupted or free of errors. Because Settha is an intermediary and does not provide the tourism service, it is not liable for the delivery, quality or safety of the Tour, which are the Agency's responsibility. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Colombian law, including the non-waivable rights the Consumer Statute grants to consumers.

16

Indemnification

You will hold Settha harmless against third-party claims arising from your breach of these Terms, from the infringement of third-party rights, or, in the case of Agencies, from the provision of the tourism service, within the limits permitted by applicable law.

17

Changes to these Terms

We may update these Terms. Material changes are notified by email at least 15 days in advance and are visible in the application. The "Last updated" date indicates the version in force. If you continue using the Platform after they take effect, you are taken to accept the updated Terms. If you do not agree, you may close your account.

18

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia, including: • The Commercial Code. • Law 1480 of 2011 (Consumer Statute). • Law 300 of 1996 (General Tourism Law). • Decree 1074 of 2015. • Law 1581 of 2012 (Personal Data Protection). Any dispute will be resolved before the competent courts of Bogotá, Colombia, without prejudice to a consumer User's right to bring claims before the Superintendency of Industry and Commerce (SIC).

19

Privacy

The processing of personal data is governed by the Privacy Policy, available at https://settha.com/privacy, which forms an integral part of these Terms.

20

Protection of children and adolescents (ESCNNA)

In compliance with Article 17 of Law 679 of 2001 and Law 1336 of 2009 (Colombia), Settha warns that the sexual exploitation and abuse of minors in Colombia are punishable under criminal and administrative law, in accordance with current legislation. Settha and the Agencies that publish on the Platform reject all forms of commercial sexual exploitation of children and adolescents (ESCNNA). Using the Platform to offer, promote, facilitate or conceal such conduct is forbidden. Related content and accounts are removed immediately, evidence is preserved and the case is reported to the competent authorities. Agencies further undertake to comply with Law 679 of 2001, Law 1336 of 2009 and their implementing regulations; to adopt and apply a code of conduct to prevent ESCNNA; to include the legal warning above in their advertising where the law requires it; not to offer, promote or facilitate such conduct; and to report to the authorities any case they become aware of. A breach leads to immediate termination of the account, removal of their tours and a report to the competent authorities. If you know of a case, report it: ICBF line 141 (free), National Police line 123, or www.teprotejo.org. You can also report it from the app or write to [email protected]; reports involving the safety of minors are reviewed first.
